Terms of Service

These Terms of Service ("Terms") govern your use of the DineSync for Clover WordPress plugin and the DineSync Hub service ("Service") provided by Monir Tech Solutions ("we", "us", or "our"). By using our Service, you agree to these Terms.
1. Service Description
DineSync for Clover consists of two components:
- DineSync for Clover Plugin: A free, open-source WordPress plugin (GPLv2 or later) that synchronizes data between WooCommerce and Clover POS
- DineSync Hub: A cloud-based middleware service that facilitates OAuth authentication, webhook forwarding, and connection monitoring between your WooCommerce site and Clover POS
2. Account and Registration
When you connect the DineSync plugin to Clover via OAuth, your site is automatically registered with the DineSync Hub. You are responsible for:
- Maintaining the security of your WordPress site and Clover account credentials
- Ensuring your use complies with Clover's terms of service and API usage policies
- Providing accurate site and contact information
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to transmit harmful, fraudulent, or illegal content
- Attempt to gain unauthorized access to the DineSync Hub or other users' data
- Reverse engineer, decompile, or disassemble the DineSync Hub service
- Use the Service in a way that could impair, overburden, or damage our servers
- Resell or redistribute access to the DineSync Hub service without authorization
4. The Plugin (Open Source)
The DineSync for Clover WordPress plugin is licensed under the GNU General Public License v2 or later (GPLv2+). You are free to use, modify, and distribute the plugin in accordance with the GPLv2 license terms. The full license text is available at https://www.gnu.org/licenses/gpl-2.0.html.
5. The Hub Service
The DineSync Hub is a proprietary cloud service. While the plugin is free and open source, the Hub service may require a subscription for continued use. We reserve the right to:
- Modify, update, or discontinue features of the Hub service
- Introduce or change pricing plans with reasonable notice
- Set usage limits based on your subscription tier
We will provide at least 30 days' notice before any pricing changes that affect your current plan.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that:
- Data is transmitted between your site, the DineSync Hub, and Clover's API
- You are responsible for your own compliance with applicable data protection laws (such as GDPR, CCPA) with respect to your customers' data
- We process data as described in our Privacy Policy
7. Third-Party Services
The Service integrates with third-party services, including:
- Clover POS API — governed by Clover's terms at https://www.clover.com/terms
- WooCommerce — governed by WooCommerce's terms at https://woocommerce.com/terms-conditions
We are not responsible for the availability, accuracy, or policies of these third-party services.
8. Service Availability
We strive to maintain high availability of the DineSync Hub but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to scheduled maintenance, unscheduled outages, or factors beyond our reasonable control.
If the Hub service is unavailable, the plugin will continue to function for direct Clover API operations (manual connection mode) but webhook-based real-time sync may be temporarily interrupted.
9. Intellectual Property
- The DineSync for Clover plugin is open source under GPLv2+
- The DineSync Hub service, its infrastructure, and proprietary code are owned by Monir Tech Solutions
- The "DineSync" name and branding are the property of Monir Tech Solutions
- "Clover" is a trademark of Fiserv, Inc. "WooCommerce" is a trademark of Automattic, Inc. These marks are used for identification purposes only.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONIR TECH SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Termination
- By You: You may stop using the Service at any time by deactivating the plugin and disconnecting from the DineSync Hub
- By Us: We may suspend or terminate your access to the Hub if you violate these Terms, with notice where practicable
Upon termination, your merchant data will be removed from the DineSync Hub. Data stored locally on your WordPress site (product mappings, sync logs, settings) will remain until you uninstall the plugin.
13. Changes to These Terms
We may update these Terms from time to time. We will notify active users of material changes by email or through the plugin's admin interface at least 30 days before changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions.
